This website is operated by NWQuailFarm, LLC (“NW Quail Farm,” “we,” “us,” or “our”). Throughout the site, the terms “we,” “us,” and “our” refer to NW Quail Farm.
NW Quail Farm offers this website, including all information, products, services, and tools available through this site, conditioned upon your acceptance of these Terms of Service and all policies referenced herein.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms of Service, including our Refund, Return & Cancellation Policy, Shipping Policy, Privacy Policy, and any product-specific terms displayed on our website.
These Terms apply to all users of the site, including browsers, customers, vendors, merchants, and contributors of content.
Please read these Terms carefully before using our website or placing an order. If you do not agree to these Terms, you should not use the Service or purchase products from us.
We reserve the right to update or modify these Terms by posting changes to this page. Changes apply prospectively as permitted by applicable law.
SECTION 1 — ONLINE STORE TERMS
By agreeing to these Terms, you represent that you are at least the age of majority in your state or jurisdiction of residence or otherwise legally permitted to enter into this transaction.

You must not transmit viruses, malware, or other harmful code through the Service.
Violation of these Terms may result in termination or restriction of access to the Service.
SECTION 2 — GENERAL CONDITIONS
We reserve the right to refuse service, cancel orders, limit quantities, or restrict future purchases where permitted by law, including in cases involving suspected fraud, abusive transactions, payment disputes, repeated false claims, or misuse of our policies.
You understand that information you submit through the Service may be transmitted over various networks. Credit card information is encrypted during transmission over networks.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission.
SECTION 3 — PRODUCT INFORMATION
We make reasonable efforts to accurately describe our products, including dimensions, quantities, weights, colors, specifications, compatibility, and other characteristics.
Natural products and animals may vary in appearance, size, weight, shape, color, and other characteristics.
For products such as egg cartons, feeders, watering equipment, cages, packaging, and accessories, customers are responsible for reviewing the listed measurements and specifications before ordering.
We do not guarantee that photographs, colors, or other representations displayed on a customer's device will be completely accurate.
We reserve the right to modify product descriptions, specifications, pricing, packaging, quantities, or availability at any time.
SECTION 4 — PRICES & AVAILABILITY
Prices are subject to change without notice.
We reserve the right to discontinue products at any time.
Certain products may have limited quantities or availability.
We may limit sales of products or services to any person, geographic region, jurisdiction, or quantity where permitted by law.
SECTION 5 — ORDERS
We reserve the right to accept, decline, limit, or cancel an order where permitted by law.
If we make a change to or cancel an order after payment, we will attempt to notify you using the email address, billing address, telephone number, or other contact information provided with the order.
Customers are responsible for providing complete and accurate billing, shipping, and contact information.
Customers are responsible for reviewing their order before completing checkout.
SECTION 6 — BILLING & PAYMENT INFORMATION
You agree to provide current, complete, and accurate purchase and account information for all purchases.
You authorize us and our payment processors to charge the payment method provided for the amount shown at checkout and any other charges you expressly authorize.
We reserve the right to refuse or cancel transactions that reasonably appear fraudulent, unauthorized, or otherwise violate these Terms.
SECTION 7 — CANCELLATIONS
Standard orders may be cancelled only before they have shipped or become committed to fulfillment.
Once an order has shipped, it cannot be cancelled.
Preorders, special orders, custom products, made-to-order products, and third-party fulfilled products may become non-cancellable once the order has been submitted to a supplier, entered production, been specially ordered, customized, or otherwise committed for fulfillment.
If an eligible product has already shipped and you no longer want it, you must request a return in accordance with our Refund, Return & Cancellation Policy.
SECTION 8 — PREORDERS, SPECIAL ORDERS & THIRD-PARTY FULFILLMENT
Certain products may be offered as preorders, special orders, made-to-order products, or products fulfilled by third-party suppliers.
Estimated availability, production, shipping, and delivery dates are estimates unless expressly guaranteed in writing.
Delays may occur because of manufacturing, supplier availability, freight transportation, carrier operations, weather, customs, or other circumstances outside our direct control.
Once a special-order or preorder purchase has been committed to fulfillment, cancellation may no longer be available as described in the applicable product terms and our cancellation policies.
SECTION 9 — RETURNS, REFUNDS & FINAL-SALE PRODUCTS
Returns and refunds are governed by our Refund, Return & Cancellation Policy, which is incorporated into these Terms.
Eligible merchandise generally has a 14-day return window beginning from delivery, subject to the conditions stated in that policy.
Eligible customer-requested returns may be subject to a 15% restocking fee, and the customer is responsible for return shipping unless otherwise stated or required by law.
Certain products are non-returnable or Final Sale because of health, safety, biosecurity, perishability, food-contact, customization, or other considerations.
These may include hatching eggs, fresh or balut eggs, live animals, frozen products, pet food and treats, food-contact packaging, custom products, special-order products, and products otherwise identified as Final Sale.
Final Sale status does not eliminate any rights a customer may have under applicable law regarding merchandise that is defective, damaged, incorrectly supplied, or materially different from what was ordered.
SECTION 10 — PAYMENT DISPUTES & CHARGEBACKS
We encourage customers to contact NW Quail Farm before initiating a chargeback or payment dispute so that we have an opportunity to investigate and resolve the issue.
A chargeback, payment dispute, cancellation request, or payment reversal does not constitute a return of merchandise.
If payment for merchandise that has already been shipped or delivered is reversed, refunded, or withdrawn through a payment dispute or chargeback, the customer is not thereby authorized to retain both the merchandise and the reversed payment.
Unless otherwise agreed to in writing or required by applicable law, a customer who retains merchandise for which payment has been reversed remains responsible for either:
1. Returning the merchandise according to return instructions provided by NW Quail Farm; or
2. Paying any outstanding amount legitimately owed for merchandise the customer retains.
NW Quail Farm reserves the right, subject to applicable law, to seek recovery of merchandise or amounts legitimately owed when merchandise is retained after the corresponding payment has been reversed.
Nothing in this section prevents a customer from exercising legitimate rights under applicable payment-network rules or applicable law.
SECTION 11 — REFUSED, UNCLAIMED & UNDELIVERABLE SHIPMENTS
Refusing delivery does not automatically cancel an order or entitle the customer to a full refund.
For eligible returnable merchandise, any refund will be determined after the returned merchandise has been received and inspected.
Original shipping charges, return shipping charges, and applicable restocking fees may be deducted from an eligible refund when permitted by law.
Non-returnable, perishable, custom, special-order, or Final Sale merchandise may not qualify for a refund merely because delivery was refused or the package was returned to sender.
Customers are responsible for providing a correct and deliverable shipping address.
SECTION 12 — SHIPPING, DELIVERY & RISK OF LOSS
Shipping and delivery estimates are estimates unless expressly guaranteed.
Carrier delays, weather, holidays, incorrect addresses, transportation disruptions, and other circumstances outside our control may affect delivery.
Customers should promptly contact us regarding packages that appear lost, damaged, delayed, or misdelivered so that we can assist with the appropriate carrier process.
A carrier's “delivered” scan may require investigation before a claim, replacement, or refund is approved.
Nothing in this section alters rights or responsibilities imposed by applicable law.
SECTION 13 — HATCHING EGGS
Hatching eggs are perishable biological products and are non-returnable.
Hatch rates may be affected by shipping, handling, temperature, incubation equipment, humidity, turning procedures, storage, and other circumstances outside our control after shipment.
Any specific hatch guarantee, shipping assurance, or other protection purchased with an order is governed by the terms applicable to that program.
SECTION 14 — LIVE ANIMALS
Live animals are subject to the availability, pickup, health, and biosecurity terms displayed on the applicable product page.
Live animals cannot ordinarily be returned after leaving our possession because doing so may create health and biosecurity risks.
Customers should inspect live animals at pickup and immediately raise any concerns.
SECTION 15 — PERISHABLE, FROZEN & FOOD PRODUCTS
Frozen, refrigerated, fresh, edible, pet-food, and other perishable products are generally non-returnable.
If a perishable shipment arrives damaged, spoiled, or otherwise unusable, the customer must contact us promptly and provide reasonable documentation, including photographs when requested.
Customers should retain the product, packaging, shipping box, and shipping label until we advise whether they are needed for a carrier, insurance, or product claim.
SECTION 16 — DAMAGE, DEFECTS & INCORRECT ITEMS
Customers should inspect orders promptly after delivery.
If merchandise arrives damaged, defective, incomplete, or incorrect, contact us at sales@nwquailfarm.com and provide the order number and reasonable supporting information or photographs.
Depending on the circumstances, an appropriate resolution may include replacement merchandise, replacement parts, store credit, refund, or another remedy.
SECTION 17 — OPTIONAL THIRD-PARTY TOOLS & SERVICES
We may provide access to tools, applications, payment services, fulfillment providers, shipping carriers, or other services operated by third parties.
We do not control all aspects of third-party services and are not responsible for their independent acts, omissions, policies, or availability except to the extent required by applicable law.
Use of third-party services may also be subject to the third party's terms.
SECTION 18 — THIRD-PARTY LINKS
Our website may contain links to third-party websites.
We are not responsible for examining or evaluating all third-party content, products, or services and do not warrant their accuracy.
Customers should review the applicable third party's policies before completing transactions directly with that party.
SECTION 19 — USER COMMENTS, FEEDBACK & SUBMISSIONS
If you submit comments, reviews, suggestions, ideas, photographs, or other materials to us, you represent that you have the right to provide those materials.
You may not submit unlawful, threatening, defamatory, obscene, infringing, fraudulent, or malicious content.
We reserve the right to remove content from our website where appropriate and permitted by law.
SECTION 20 — PERSONAL INFORMATION
Submission and processing of personal information through the Service is governed by our Privacy Policy and applicable law.
SECTION 21 — ERRORS, INACCURACIES & OMISSIONS
Occasionally, information on our site may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, availability, or other information.
We reserve the right to correct errors, update information, or cancel affected orders where permitted by applicable law.
SECTION 22 — PROHIBITED USES
You may not use the site or its content for unlawful purposes; to violate applicable laws or regulations; to infringe intellectual-property rights; to transmit malicious code; to collect personal information unlawfully; to spam, phish, scrape, or interfere with the security or operation of the Service; or for fraudulent or deceptive activity.
We reserve the right to terminate or restrict use of the Service for prohibited conduct.
SECTION 23 — DISCLAIMER OF WARRANTIES
Except as expressly stated by NW Quail Farm or required by applicable law, the Service and products are provided without additional warranties beyond those that cannot lawfully be excluded.
We do not guarantee that access to the website will always be uninterrupted, timely, secure, or error-free.
Nothing in these Terms excludes warranties, guarantees, or other consumer rights that cannot legally be waived.
SECTION 24 — LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, NW Quail Farm and its owners, employees, agents, contractors, suppliers, service providers, and affiliates will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Service or products.
Nothing in these Terms limits liability that cannot lawfully be limited or excluded.
SECTION 25 — INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless NWQuailFarm, LLC and its owners, affiliates, employees, agents, contractors, and service providers from third-party claims arising from your unlawful misuse of the Service, your violation of these Terms, or your infringement of another person's rights.
SECTION 26 — SEVERABILITY
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
SECTION 27 — TERMINATION
These Terms remain effective unless terminated by you or us.
We may terminate or restrict access to the Service where permitted by law if we reasonably believe you have materially violated these Terms.
Obligations and liabilities incurred before termination will survive where appropriate.
SECTION 28 — ENTIRE AGREEMENT
These Terms, together with our Refund, Return & Cancellation Policy, Shipping Policy, Privacy Policy, Purchase Options Cancellation Policy, product-specific terms, and other policies expressly incorporated into a transaction, constitute the agreement between you and NW Quail Farm regarding use of the Service and applicable purchases.
SECTION 29 — GOVERNING LAW
These Terms and any separate agreements through which we provide Services are governed by applicable federal law and the laws of the State of Washington, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Nothing in these Terms deprives a consumer of protections that cannot legally be waived.
SECTION 30 — CHANGES TO THESE TERMS
We reserve the right to update these Terms from time to time by posting a revised version on our website.
Changes will apply prospectively as permitted by applicable law. The version applicable to an order will generally be the version in effect when that order was placed, except where otherwise required by law.
